Acceptance of Terms

By registering for and using MentorGuia.com, you agree to comply with and be bound by these Terms of Use. If you do not agree to these Terms, please do not use our services.

Eligibility and Geographic Restrictions

Eligibility: You must be at least 18 years old to register for an account. You represent and warrant that all information you provide is accurate and current.

Geographic Restrictions: MentorGuia’s services are currently available exclusively to residents or users who are legally located in, and have valid billing addresses within, the United States or Colombia. By using our services, you represent and warrant that you are located in, and are legally eligible to access and use, the services in these regions. Notwithstanding any technical limitations or current lack of automated enforcement mechanisms, if MentorGuia discovers or reasonably suspects that you are accessing or using the Site from a location outside these regions, we reserve the right to suspend or terminate your account without liability, and may refund any fees as appropriate.

User Registration and Account Security

• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account and password.
• You agree to notify us immediately of any unauthorized use of your account.

Service Description and Role of MentorGuia

MentorGuia.com is a platform that connects users (“Clients”) with mentors who provide self-improvement and mental preparation programs. The mentors are independent providers, and MentorGuia does not control the content of their programs nor is it responsible for any advice or services rendered by mentors.

Financial Arrangement: Payments made by Clients are processed through our payment processor (e.g., Stripe). A service fee is applied to each transaction to support the operation of the MentorGuia.com platform, with the remaining funds disbursed to the respective mentor. Clients must provide accurate billing information.

Payment Processing

Payments are processed through Stripe. By making a payment, you agree to abide by these Terms and Stripe’s applicable terms and conditions. Although we may use data (such as billing addresses or IP information) to help determine your location, you acknowledge that our current systems may not be 100% accurate. Your representation regarding your geographic location is a material term of your use of the Site.

User Conduct

• You agree to use the Site only for lawful purposes and in accordance with these Terms.
• You agree not to engage in conduct that could harm, disrupt, or interfere with the proper functioning of the Site.
• You agree not to attempt to gain unauthorized access to our systems.

Intellectual Property

• All content, design, graphics, and organization of the Site are the intellectual property of MentorGuia or our licensors, protected by applicable laws.
• You agree not to reproduce, duplicate, copy, or exploit any portion of the Site without our express written permission.

Disclaimer of Warranties and Limitation of Liability

• The Site and all services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
• MentorGuia disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• In no event shall MentorGuia, its affiliates, or its directors be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Site.

Termination

We reserve the right to suspend or terminate your account and access to the Site at our sole discretion, without prior notice, for any conduct that violates these Terms, including misrepresentations about your location.

Changes to Terms

We may revise these Terms from time to time. Any changes will be posted on this page, and your continued use of the Site after such changes constitutes your acceptance of the new Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in California.

Communications and Messaging Consent

By registering for and using MentorGuia.com, you expressly consent to receive communications from us, including (but not limited to):

• Automated text messages (SMS) and notifications regarding session reminders, scheduling updates, chat notifications, program updates, security messages, and other important updates.
• Message frequency may vary based on your activity (typically 1–5 messages per week).
• Message and data rates may apply based on your carrier.
• You may opt out of non-essential communications by following the provided opt-out instructions; however, essential service-related messages cannot be opted out of while your account remains active.

Indemnification

You agree to indemnify, defend, and hold harmless MentorGuia, its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Site, your violation of these Terms, or any infringement of the rights of others.

Refund and Cancellation Policy

Cancellation Method: All appointment cancellations must be initiated via the user dashboard. Each scheduled appointment will be displayed with a "Join" and a "Cancel" button. By clicking the "Cancel" button, the appointment is immediately cancelled, and an automatic notification will be sent to both the client and the mentor.

Mentor Cancellation: If a mentor cancels an appointment, a full refund (100%) will be issued to the client. The mentor should use the dashboard cancellation feature (or contact support if needed) to ensure the client is promptly notified.

Client Cancellation: If a client cancels an appointment via the dashboard, the refund will depend on the time remaining until the scheduled appointment:

• - More than 24 hours before the appointment: A 90% refund for multiple sessions or a 95% refund for a single session.
• - Between 12 and 24 hours before the appointment: A 60% refund.
• - Less than 12 hours before the appointment: A 30% refund (late cancellation fee applies).

No-Show Policy: In the event of a no-show (failure to appear without prior cancellation):

• - If the mentor does not show up, a full refund will be issued to the client.
• - If the client does not show up, no refund will be issued.

Appointment Start Time: Once an appointment has commenced, cancellations are not permitted and no refunds will be issued.

By scheduling an appointment on MentorGuia.com, both mentors and clients acknowledge and agree to these refund and cancellation terms.

No obstante limitaciones técnicas o la falta de mecanismos automatizados de cumplimiento, si MentorGuia descubre o sospecha razonablemente que usted está accediendo o utilizando el Sitio desde una ubicación fuera de estas regiones, nos reservamos el derecho de suspender o terminar su cuenta sin responsabilidad, pudiendo reembolsar cualquier tarifa según corresponda.

Registro de Usuario y Seguridad de la Cuenta

• Usted acepta proporcionar información precisa, actual y completa durante el registro.
• Usted es responsable de mantener la confidencialidad de su cuenta y contraseña.
• Usted se compromete a notificarnos de inmediato sobre cualquier uso no autorizado de su cuenta.

Descripción del Servicio y Rol de MentorGuia

MentorGuia.com es una plataforma que conecta a los usuarios ("Clientes") con mentores que ofrecen programas de auto-mejoramiento y preparación mental. Los mentores son proveedores independientes, y MentorGuia no controla el contenido de sus programas ni es responsable de ningún consejo o servicio proporcionado por ellos.

Arreglo Financiero: Los pagos realizados por los clientes se procesan a través de nuestro procesador de pagos (por ejemplo, Stripe). Se aplica una tarifa de servicio a cada transacción para respaldar el funcionamiento de la plataforma MentorGuia.com, y los fondos restantes se distribuyen al mentor respectivo. Los clientes deben proporcionar información de facturación precisa.

Procesamiento de Pagos

Los pagos se procesan a través de Stripe. Al realizar un pago, usted acepta cumplir con estos Términos y con los términos y condiciones aplicables de Stripe. Aunque podamos utilizar datos (como direcciones de facturación o información de IP) para determinar su ubicación, usted reconoce que nuestros sistemas actuales pueden no ser 100% precisos. Su representación sobre su ubicación geográfica es un término material para el uso del Sitio.

Conducta del Usuario

• Usted se compromete a utilizar el Sitio únicamente para fines legales y de conformidad con estos Términos.
• Usted se compromete a no participar en conductas que puedan dañar, interrumpir o interferir con el funcionamiento adecuado del Sitio.
• No intentará obtener acceso no autorizado a nuestros sistemas.

Propiedad Intelectual

• Todo el contenido, diseño, gráficos y organización del Sitio son propiedad intelectual de MentorGuia o de nuestros licenciantes, y están protegidos por las leyes aplicables.
• Usted se compromete a no reproducir, duplicar, copiar o explotar ninguna parte del Sitio sin nuestro permiso expreso por escrito.

Descargo de Responsabilidad y Limitación de Responsabilidad

• El Sitio y todos los servicios se ofrecen “tal como están” y “según disponibilidad”, sin garantías de ningún tipo, expresas o implícitas.
• MentorGuia renuncia a todas las garantías, incluyendo las garantías implícitas de comerciabilidad, idoneidad para un propósito particular y no infracción.
• En ningún caso MentorGuia, sus afiliados o directores serán responsables por daños indirectos, incidentales, especiales, consecuentes o punitivos derivados del uso o la imposibilidad de uso del Sitio.

Terminación

Nos reservamos el derecho de suspender o terminar su cuenta y el acceso al Sitio a nuestra entera discreción, sin previo aviso, por cualquier conducta que infrinja estos Términos, incluyendo representaciones falsas sobre su ubicación.

Cambios a los Términos

Podremos revisar estos Términos de vez en cuando. Cualquier cambio se publicará en esta página, y el uso continuado del Sitio después de dichos cambios constituirá su aceptación de los nuevos Términos.

Ley Aplicable y Resolución de Disputas

Estos Términos se regirán e interpretarán de conformidad con las leyes del Estado de California, sin tener en cuenta sus principios de conflicto de leyes. Cualquier disputa derivada de estos Términos se resolverá en los tribunales estatales o federales ubicados en California.

Consentimiento para Comunicaciones y Mensajes

Al registrarse y utilizar MentorGuia.com, usted acepta recibir comunicaciones de nuestra parte, incluyendo (pero no limitándose a):

• Mensajes de texto automatizados (SMS) y notificaciones relacionadas con recordatorios de sesiones, actualizaciones de horarios, notificaciones de chat, actualizaciones de programas, mensajes de seguridad y otras actualizaciones importantes.
• La frecuencia de los mensajes puede variar según su actividad (típicamente 1–5 mensajes por semana).
• Se podrán aplicar tarifas de mensaje y datos según su operador.
• Usted podrá optar por no recibir comunicaciones no esenciales siguiendo las instrucciones proporcionadas, aunque los mensajes esenciales no podrán ser desactivados mientras su cuenta esté activa.

Indemnización

Usted acepta indemnizar, defender y eximir de responsabilidad a MentorGuia, sus afiliados y a sus respectivos directores, empleados y agentes de cualquier reclamo, responsabilidad, daño, pérdida o gasto que surja del uso del Sitio, la violación de estos Términos o la infracción de derechos de terceros.

Política de Reembolso y Cancelación

Método de Cancelación: Todas las cancelaciones de citas deben iniciarse a través del panel de usuario. Cada cita programada se mostrará con un botón "Unirse" y un botón "Cancelar". Al hacer clic en el botón "Cancelar", la cita se cancelará inmediatamente y se enviará una notificación automática tanto al cliente como al mentor.

Cancelación del Mentor: Si un mentor cancela una cita, se emitirá un reembolso completo (100%) al cliente. El mentor debe utilizar la función de cancelación del panel (o contactar al soporte si es necesario) para asegurar que el cliente sea notificado de inmediato.

Cancelación del Cliente: Si un cliente cancela una cita a través del panel, el reembolso dependerá del tiempo restante hasta la cita programada:

• - Más de 24 horas antes de la cita: Un reembolso del 90% para múltiples sesiones o del 95% para una sola sesión.
• - Entre 12 y 24 horas antes de la cita: Un reembolso del 60%.
• - Menos de 12 horas antes de la cita: Un reembolso del 30% (se aplica una tarifa por cancelación tardía).

Política de No Presentación: En caso de no presentarse (falla en aparecer sin cancelación previa):

• - Si el mentor no se presenta, se emitirá un reembolso completo al cliente.
• - Si el cliente no se presenta, no se emitirá ningún reembolso.

Hora de Inicio de la Cita: Una vez que la cita ha comenzado, no se permiten cancelaciones y no se emitirán reembolsos.

Al programar una cita en MentorGuia.com, tanto los mentores como los clientes reconocen y aceptan estos términos de reembolso y cancelación.
